Terms of Service

TheVIXtrader (“TheVIXtrader”, “we”, “us”) is operated by John Smith Kristiansen, a sole operator providing the service described below. By accessing or using the platform you enter into an agreement with John Smith Kristiansen on these terms.

TheVIXtrader is an AI-assisted volatility intelligence and market-awareness platform. It provides dashboards, signals, regime context, alerts, and discussion features intended for informational and educational use.

TheVIXtrader is not a broker, exchange, or trading venue.

• We do not execute, route, or facilitate trades.
• We do not custody funds or securities.
• We do not provide personalized investment, financial, legal, or tax advice.
• You are solely responsible for any decisions you make based on information you see on the platform.

By creating an account, viewing the dashboard, or otherwise using the service, you confirm that you have read, understood, and agreed to these terms. If you don't agree, please don't use the service.

You must be of legal age in your jurisdiction to enter a binding contract. If you use TheVIXtrader on behalf of an organization, you confirm you have authority to bind that organization to these terms.

You're responsible for keeping your login credentials confidential and for all activity under your account. Please give us accurate information and keep it up to date.

Some features (collectively “Premium Intelligence”) require an active subscription. Subscriptions renew automatically at the price and cadence shown at checkout until canceled.

During early access we offer Founding Member pricing. Once you subscribe at a Founding Member price, that price remains locked for your subscription as long as it stays continuously active. If your subscription lapses or is canceled, re-subscribing later will use whatever pricing is then publicly available.

Payment, billing, taxes, invoicing, refunds, and cancellation mechanics are handled by Paddle — see the Payments & refunds section below.

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Specific payment, billing, and renewal terms are governed by Paddle's Buyer Terms. Refund handling is described in our Refund Policy.

You agree not to misuse the service. In particular, you won't:

• use the service unlawfully or for fraudulent purposes;
• infringe anyone's intellectual property or other rights;
• attempt to interfere with the security, integrity, or availability of the service (no probing, scraping at scale, malware, or bypassing technical limits);
• resell, redistribute, or republish the service or its data without written permission;
• reverse engineer or attempt to derive the source of the service except where the law permits it.

Premium discussion areas are part of a moderated, professional community. When participating you agree to:

• keep contributions on-topic, respectful, and free of harassment or hate speech;
• refrain from posting spam, promotions, pump-and-dump material, or coordinated market manipulation;
• refrain from sharing personalized financial advice or pretending to act as a licensed professional;
• not share other members' private information or community content publicly without consent.

We may remove content, hide messages, or restrict accounts that breach these rules. You retain ownership of what you post; you grant us a limited license to host, display, and moderate it solely so we can run the community.

Information on TheVIXtrader — including dashboards, signals, alerts, regime classifications, AI summaries, and community contributions — is provided for general and educational purposes only. It is not financial, investment, legal, or tax advice and is not a recommendation to buy, sell, or hold any security or instrument.

Markets carry risk. You are responsible for your own decisions and should consult a qualified professional for advice specific to your situation.

We work hard to keep the service available, accurate, and timely, but we don't guarantee uninterrupted or error-free operation. Real-time market data is sourced from third parties and may be delayed, incomplete, or unavailable. Features may change as the platform evolves.

The service, its software, design, branding, documentation, and underlying intelligence remain the property of TheVIXtrader. We grant you a limited, non-exclusive, non-transferable right to use the service for your personal or internal business use within the plan you've subscribed to.

We may suspend or terminate access if:

• you materially breach these terms or our acceptable use rules;
• payment fails or remains overdue;
• your activity creates security, fraud, legal, or platform-quality risk;
• we're required to do so by law.

You can stop using the service at any time. Cancellation of a paid subscription is described in the Refund Policy.

To the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you've paid us in the twelve months preceding the claim. We won't be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill. Nothing in these terms limits liability that cannot be limited by law (such as fraud or personal injury caused by negligence).

We may update these terms as the platform evolves. When we do, we'll post the new version here and update the “Last updated” date. Continued use of the service after changes take effect means you accept the updated terms.

These terms are governed by the laws of the jurisdiction in which John Smith Kristiansen operates. Any dispute will be brought in the competent courts of that jurisdiction, except where mandatory consumer- protection law gives you the right to bring proceedings elsewhere.
